Definitions

  • Service: Refers to the MagnificentH Application and Website.
  • User Roles: Visitors (access and view rights), Creators (same as Visitors plus listing rights).

User Obligations to respect licensing terms

  1. Far and foremost, use of Service requires to follow license terms by rightsholders and providers of images, either uploaded or made available via APIs:
    • specific licenses applied to images are visible on each image displayed (visible on the Create page) as well as in “Curated with” section to each published micro-museum.
  2. License Types Explained For Creative Commons Images:
    • Most images carry CC licenses like CC BY or CC BY-SA, enabling creative reuse with simple conditions: attribute the creator, link the license, and sometimes share alike. Our platform handles this seamlessly in the “Curated with” section of every micro-museum, embedding proper credits. Here’s what the rights statement mean in plain language:
      • CC0 (No Rights Reserved): Public domain dedication—use freely for any purpose, no attribution needed.
      • CC BY (Attribution): Remix, adapt, and share commercially or non-commercially, as long as you credit the creator and link the license.
      • CC BY-SA (Attribution-ShareAlike): Like CC BY, but your adaptations must use the same license.
      • CC BY-NC (Attribution-NonCommercial): Reuse freely (except commercial), with attribution.
      • CC BY-NC-SA (Attribution-NonCommercial-ShareAlike): Like CC BY-NC, but adaptations share alike.
      • CC BY-ND (Attribution-NoDerivs): Share as-is (no remixing), with attribution.
      • CC BY-NC-ND (Attribution-NonCommercial-NoDerivs): Share unchanged, non-commercially, with attribution—the most restrictive.
  3. License Types Explained For Copyrighted Images:
    • Images with statements “In Copyright” (or when there is no license stated, which is the case when Users upload images) mean the images are protected by full copyright, unless they are reused with permission or rely on EU exceptions. One such exception relevant to micro-museum stories is for creative reuse for quotation, criticism, or review, e.g. when paired with your transformative storytelling context. When creating micro-museums with images labelled “In Copyright”, balance the use by adding your curation and narrative for fair and analytical use.

OTHER User Obligations

  1. Content Posting: Users are responsible for posted content and must avoid unlawful or objectionable material. 
  2. Community: MagnificentH is built for Users, and by joining you are part of our community. Make sure everyone feels safe and respected.
  3. What We Don’t Allow: We don’t permit content that is illegal. This includes hate speech or other information aimed at misleading or hurting others. Your User rights and content may be removed if you repeatedly breach the content moderation rules or otherwise violate these Terms of Service.
  4. IP rights: The Service – excluding Content provided by You or other users – and functionality are the exclusive property of the Company and its licensors.
  5. IP rights of Service users: The Service is protected by copyright, trademark and other laws of both the Country and foreign countries of Users. For images uploaded via APIs etc the license is stated on each image and/or profile of the contributing partner. USE of images from connected image partners

  1. MagnificentH makes image discovery, access, and curation available free of charge under all MagnificentH service plans.
  2. This means that MagnificentH does not charge users for its image-related platform service. It does not mean that every image available through MagnificentH is free from copyright or other restrictions.
  3. The rights and reuse conditions for each image are shown with the image and/or in the relevant source information. Users are responsible for following the applicable rights statement, licence, source terms, or legal exception.

  5. MagnificentH’s inclusion of an image does not itself grant permission to reproduce, download, publish, sell, or redistribute it.

AI PROHIBITION

  1. Use of content made available through the Service for scraping, crawling, text and data mining, dataset creation, or artificial intelligence training is strictly prohibited without prior written consent from MagnificentH.
  2. MagnificentH expressly reserves all rights and opts out of all text and data mining exceptions under applicable law, including Article 4 of Directive (EU) 2019/790.
  1. Governing Law: Swedish law applies, unless otherwise applicable by means of international law.
  2. Intellectual Property: Users retain rights to their content but grant the Company usage rights.

Changes to Terms

The Company may revise Terms with 30 days’ notice for material changes. Continued use implies acceptance.

By continuing to access or use the Service, You agree to be bound by the terms. If You do not agree to the terms, in whole or in part, please stop using the Application or Website and the Service.
